Terms of Service for Selling Maps on Scribble Maps

Scribble Maps Terms of Service

1. Eligibility and Account Integrity
   To sell maps on Scribble Maps, users must create an account and connect it via Stripe Connect to receive payments. Users are responsible for maintaining the confidentiality of their account information and for all activities that occur under their account.
    
2. Payment and Fees
   Users may set prices for their maps and offer them for sale on a one-time, monthly, or yearly subscription basis. Payments will be processed through Stripe Connect, and funds will be transferred directly to the user’s connected Stripe account, subject to Stripe’s terms and fees.
    
3. Liability Limitation
   Scribble Maps and its affiliates are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from or related to the use of the maps sold on our platform. This includes, but is not limited to, any damages resulting from decisions made or actions taken based on the information contained within or derived from purchased maps. Users acknowledge that maps and geographic data are subject to potential inaccuracies and are intended for general informational purposes only.
   Scribble Maps does not warrant the accuracy, completeness, or usefulness of any map, and users agree that reliance on any map obtained through our platform is strictly at their own risk. Scribble Maps disclaims all liability and responsibility arising from any reliance placed on such materials by users or by anyone who may be informed of any of its contents.
    
4. Legal Rights and Prohibited Content
   Users must have the legal rights to the maps and associated data they sell on Scribble Maps. Selling maps that promote illegal activities or contain illegal content is strictly prohibited and will result in immediate termination of the user’s account and potential legal action.
    
5. Sample Map Provision
   Every map listed for sale must include a "sample map" that accurately represents the data and functionality of the full product. Misleading sample maps are grounds for discontinuation of sales and/or termination of the user’s account.
    
6. Marketing Rights
   If a user opts-in to marketing promotions, Scribble Maps reserves the right to use their maps in marketing materials, including newsletters, social media posts, and other promotional outlets to enhance visibility and sales potential.
    
7. Content Moderation and Access
   Scribble Maps reserves the right to access, view, and moderate the maps sold on our platform to ensure compliance with our content guidelines and applicable laws. This may include removing content that violates these guidelines without prior notice.
    
8. Sales Discontinuation and Refunds
   Scribble Maps reserves the right to discontinue the sale of any map at its sole discretion. In the event of discontinuation, Scribble Maps may, at its discretion, issue refunds to buyers as deemed appropriate and in accordance with applicable laws.
    
9. Account Termination
   Scribble Maps reserves the right to terminate a user’s account if they violate any terms of service, including but not limited to, infringement of intellectual property, distributing prohibited content, or engaging in fraudulent activities. Upon termination, any outstanding earnings may be withheld or refunded to buyers as per legal requirements.
    
10. Intellectual Property
    By selling maps on Scribble Maps, users affirm that they own or have the necessary licenses to use all the content included in their maps, and they grant Scribble Maps a license to host, display, and moderate this content as needed for the operation of the service.
     
11. Data Protection and Confidentiality
    User Data Handling: Scribble Maps is committed to protecting the privacy and confidentiality of the data contained within the maps sold on our platform. We do not sell, trade, or otherwise transfer to outside parties the personal or proprietary data contained in paid maps. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.
    Third-Party Disclosure: We do not disclose any information from paid maps to third parties unless required by law or necessary to enforce our site policies, or protect ours or others' rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
    Data Security: We implement a variety of security measures to maintain the safety of your personal information when you enter, submit, or access your personal information. We use encryption and other technologies to ensure the secure transmission of all data. Users should safeguard their login information and treat such as confidential, not disclosing it to any third
     
12. Data Copying and Security
    While Scribble Maps implements stringent security measures to protect data, it is possible that data from paid maps might be copied or replicated manually by users. Scribble Maps cannot completely prevent the copying of data displayed or accessed through our platform and therefore is not liable for any unauthorized use, copying, or distribution of map data by users. We encourage map creators to consider these risks when choosing to sell maps on our platform.
     
13. Map Deletion and Discontinuation
    Once a map has been paid for and sold on Scribble Maps, it cannot be deleted from our service due to the need to maintain access for users who have purchased the map. However, sellers may choose to discontinue further sales of their maps at any time. Discontinuation will prevent new purchases but will not affect the access rights of users who have already purchased the map. Scribble Maps reserves the right to discontinue sales of any map at its discretion, especially in cases where the map violates our terms of service or applicable laws.
     
14. Pro Basic Subscription Requirement
    To list and continue selling maps on Scribble Maps, users must maintain at least a "Pro Basic Subscription" with our platform. Failure to keep this subscription active will result in the immediate cessation of sales for their maps. If a user cancels or fails to renew their Pro Basic Subscription, their maps will no longer be available for purchase until the subscription is reactivated.
     
15. Account Requirement for Accessing Paid Maps
    To access and utilize paid maps on Scribble Maps, users must register for and maintain an active Scribble Maps account. All paid map transactions and subsequent access to these maps require users to be logged in to their account. This ensures secure and personalized access to purchased content and enables us to provide ongoing support, updates, and service enhancements. Users without an account will not have access to paid map features, emphasizing the need for account registration and login for full functionality.
     
16. Changes to Terms
    Scribble Maps reserves the right to modify these terms at any time. Changes will take effect immediately upon posting on our platform. Continued use of the service after such changes will constitute acceptance of the new terms.
     
17. Governing Law
    These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Scribble Maps operates, without regard to its conflict of law provisions.

Stripe Services Agreement

We partner with Stripe to handle billing and by creating paid maps on Scribble Maps you also agree to the Stripe Services Agreement.
